These terms and conditions (“Terms”) govern your use of the EcoMat platform and related services (“Services”), including the EcoMat website and mobile applications. By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

1. Registration and Account In order to use our Services, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password, and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Use of Services You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate EcoMat or an EcoMat employee, another user, or any other person or entity.

3. User Conduct You agree to abide by the following rules of conduct while using our Services:

• Do not harass, threaten, or abuse other users.
• Do not use our Services to violate the privacy or intellectual property rights of others.
• Do not use our Services to distribute viruses or other harmful computer code.
• Do not engage in any activity that interferes with or disrupts our Services.

4. Booking and Payment When you book a ride using our Services, you agree to pay the fare quoted at the time of booking. You may pay using a valid credit or debit card or other payment methods available on our platform. All payments are processed through a secure payment gateway.

5. Cancellation and Refunds You may cancel your booking at any time before the ride begins. If you cancel a ride after the driver has been dispatched, you may be charged a cancellation fee. Refunds for cancelled rides will be processed within a reasonable time.

6. Intellectual Property All content and materials on our platform, including text, graphics, logos, images, and software, are the property of EcoMat or its licensors and are protected by intellectual property laws. You may not use, copy, or reproduce any of our content or materials without our express written consent.

7. Warranties and Disclaimers Our Services are provided on an “as is” and “as available” basis, without any warranties of any kind. We do not guarantee that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that the information on our platform is accurate, complete, or up-to-date.

8. Limitation of Liability In no event shall EcoMat or its affiliates, partners, or licensors be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our Services. Our total liability for any claim arising out of or in connection with these Terms shall not exceed the amount paid by you for the ride in question.

9. Indemnification You agree to indemnify and hold harmless EcoMat and its affiliates, partners, and licensors from any and all claims, damages, expenses, and liabilities arising out of or in connection with your use of our Services, your violation of these Terms, or your violation of any applicable law or regulation.

10. Termination We reserve the right to terminate your account and access to our Services at any time and for any reason, including if we believe you have violated any of our policies or terms an conditions.

11. Payment and Refunds Ecomat uses a secure payment system to process payments made through the platform. Users are required to provide accurate and up-to-date payment information to make payments for trips. The platform offers refunds for cancellations made by users within a specified timeframe. Refunds are made to the original payment method, and processing times may vary.

12. User Content Users are solely responsible for any content they upload, post, or otherwise make available on the platform. Ecomat does not claim ownership of any user-generated content and is not responsible for any such content’s accuracy, quality, or legality. Users grant Ecomat a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use, copy, modify, create derivative works of, distribute, publicly display, publicly perform, and otherwise exploit in any manner such user-generated content in all formats and distribution channels now known or hereafter devised (including in connection with the Ecomat platform and Ecomat’s business and on third-party sites and services), without further notice to or consent from the user, and without the requirement of payment to the user or any other person or entity.

13. Prohibited Conduct Users agree not to engage in any of the following prohibited conduct while using the Ecomat platform: a. Violating any applicable laws, rules, or regulations. b. Using the platform for any illegal, harmful, or fraudulent purposes. c. Uploading or transmitting viruses, worms, or any other harmful code. d. Interfering with or disrupting the integrity or performance of the platform or its related systems or networks. e. Attempting to gain unauthorized access to any portion of the platform, including other users’ accounts. f. Harassing, threatening, or intimidating other users or Ecomat staff. g. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

14. Disclaimer of Warranties The Ecomat platform is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Ecomat makes no warranty that the platform will be error-free, uninterrupted, secure, or free from viruses or other harmful components. Use of the platform is at the user’s own risk.

15. Limitation of Liability In no event shall Ecomat, its directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Ecomat platform, whether based on contract, tort, strict liability, or any other legal theory. Ecomat’s liability for any claims arising out of the use of the platform shall not exceed the amount paid by the user to Ecomat for the use of the platform.

16. Indemnification Users agree to indemnify and hold harmless Ecomat, its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from or related to the user’s use of the Ecomat platform or any breach of these terms and conditions.

17. Governing Law and Dispute Resolution These terms and conditions shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these terms and conditions shall be resolved through arbitration in accordance with the Arbitration Act of Kenya. The arbitration shall be conducted in English, and the arbitration award shall be final and binding on both parties.
